Is the use of knw. sentiment analysis prohibited under the EU AI regulation?
No. The AI regulation only prohibits emotion recognition in specific contexts such as the workplace or educational institutions where there is an imbalance of power. AI sentiment analysis is used exclusively for the evaluation of events and analyzes aggregated audience reactions - not individual persons. Therefore, the ban does not apply.
Does the knw. sentiment analysis process special personal data?
No. Facial recognition is used exclusively to derive emotions, not for identification purposes. The data is anonymized and deleted immediately after collection. This means that there is no processing of special categories of personal data within the meaning of Art. 9 GDPR.
Why is participant consent not required?
Consent would be possible but is often difficult to implement for large events. Since the knw. sentiment analysis works in a data-saving and anonymized way, the processing can be legally based on the legitimate interest of the organizer.
Why is the knw. sentiment analysis legally permissible despite the AI regulation?
The purpose of the AI regulation is to protect against surveillance and discrimination in relationships of dependency. Since knw. does not carry out any personal evaluation and the data is immediately anonymized this protection is not affected. Even if our own employees are present, the focus remains on the overall impact of the event.
What is the legal basis for data processing?
The processing is based on the legitimate interest of the organizer in accordance with Art. 6 para. 1 lit. f GDPR. The aim is to optimize events. Immediate anonymization and other technical and organizational measures minimize the intensity of interference and protect the interests of the participants.
